CAREER

CDZ represented, on a pro bono basis, before the courts of first and second instances, a history teacher who also taught religion and was a trade union member.

The dispute concerned a wrongful dismissal and the main claim was for unequal treatment on account of employment basis and employment termination procedure. The school terminated the teacher’s employment after he had been stripped of the right to teach religion notwithstanding the fact that he was protected by his trade union membership.

The court of first instance did not allow the claim of unequal treatment but awarded damages to the dismissed teacher for unfair employment termination. The court of second instance modified the judgment to the teacher’s advantage and reinstated him as a history teacher and awarded him damages for the entire period of unemployment. The judgment is final and non-appealable.

The employee was represented by Piotr Kryczek, legal advisor, and Weronika Papucewicz, advocate.
